Terms of Service

These Terms of Service (“Terms”) govern your access to and use of trivai, an AI-powered trivia game (the “Service”) operated by Anura Works LLC(“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. By using trivai, you represent and warrant that you are 13 or older. We do not knowingly collect information from anyone under 13.

If you are under 18, you may use the Service only with the permission of a parent or guardian, and they must agree to these Terms on your behalf.

Some countries set a minimum age for consenting to online services on your own — in the EU and UK this is between 13 and 16 depending on where you live. If you are under that age in your country, you need a parent or guardian’s permission to use trivai.

2. Your account

You can create an account with an email and password or through a supported third-party login (such as Google or Discord). You are responsible for keeping your credentials secure and for all activity that occurs under your account. Provide accurate information and keep it up to date. Notify us promptly at support@trivai.games if you suspect unauthorized use of your account.

3. Tokens

The Service uses virtual tokens to play games. Tokens are a limited, revocable license to access gameplay features. Tokens:

• have no monetary value, are not currency, and are not redeemable for cash;
• are non-transferable and may not be sold, traded, or exchanged outside the Service;
• are consumed when you start a game and are not returned once consumed; and
• may be forfeited if your account is suspended or terminated for a violation of these Terms.

We may offer free promotional tokens (for example, a welcome bonus). Promotional tokens have no cash value and may expire or be withdrawn at any time.

4. Purchases and billing

Token purchases are processed by our payment provider, Stripe. By purchasing tokens, you authorize the applicable charge to your selected payment method and represent that you are authorized to use it. Prices are shown at the point of purchase and may change over time. You are responsible for any taxes associated with your purchase. Tokens are delivered to your account once payment is confirmed.

If you are under 18, you may buy tokens only with the permission of a parent or guardian, and they must be the one who accepts the charges. If you are a parent or guardian and a purchase was made on your payment method without your permission, contact us at support@trivai.games and we will refund it.

5. Refunds

Because tokens are digital goods that are delivered and consumable immediately, purchases are generally final. Please review our Refund Policy for details and the limited circumstances in which we issue refunds.

6. AI-generated content and accuracy

trivai uses artificial intelligence to generate trivia questions and to evaluate answers. AI-generated content can be inaccurate, incomplete, or out of date. Questions, answers, and answer judgments are provided for entertainment purposes and should not be relied upon as factual, professional, or authoritative. If you believe an answer was judged incorrectly, you may use any in-game review or appeal feature where available, but we do not guarantee any particular outcome.

7. Acceptable use

You agree not to:

• use bots, scripts, scrapers, or other automated means to access or play the Service;
• cheat, exploit bugs, or manipulate scores, tokens, or game outcomes;
• reverse engineer, decompile, or attempt to extract source code or underlying data;
• submit prompts or content that is illegal, infringing, hateful, harassing, or otherwise abusive;
• interfere with, overload, or disrupt the Service or its infrastructure; or
• resell, sublicense, or commercially exploit the Service without our written permission.

8. User-provided content

When you provide category topics, prompts, or other input, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and store that input to operate and improve the Service. You are responsible for the content you submit and represent that you have the rights to submit it.

9. Intellectual property

The Service, including its software, design, branding, and content (excluding your input), is owned by Anura Works LLC and its licensors and is protected by intellectual property laws. These Terms do not grant you any rights in our trademarks or other brand features.

10. Third-party services

The Service relies on third parties — including authentication providers and our payment processor — and integrates with them to function. Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services.

11. Suspension and termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or if we reasonably believe your use poses a risk to the Service or other users. You may stop using the Service at any time. On termination, your right to use the Service and any remaining tokens cease.

12. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate.

13. Limitation of liability

To the maximum extent permitted by law, Anura Works LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD $50.

14. Indemnification

You agree to indemnify and hold harmless Anura Works LLC from any claims, damages, and expenses arising out of your use of the Service or your violation of these Terms.

15. Changes

We may modify the Service or these Terms from time to time. If we make material changes, we will update the “Last updated” date above and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

16. Governing law

These Terms are governed by the laws of New Jersey, USA, without regard to its conflict-of-laws rules. Any disputes will be resolved in the courts located in New Jersey, USA, unless otherwise required by applicable law.
